Florida Sheriff's Office Forced to Return Seized Crypto After Legal Challenge
Authorities in Volusia County, Florida, were mandated to return 1.19121 BTC and cover legal fees following a flawed seizure of cryptocurrency from an EU-licensed brokerage's Kraken account. The seizure stemmed from investigations into a $20,000 fraud in Wisconsin and Florida but lacked proper documentation; the warrant was not filed with the court and skipped a case number. The brokerage, which cooperated with the investigation, had its assets frozen without any link to the alleged fraud. Attorney Leslie Sammis, representing the brokerage, examined the case and discovered due process violations, leading to the agreement from the sheriff's office to restore the crypto, retrieve $95,030.59 sent to Wisconsin, and cover attorney costs. This case highlights serious procedural flaws in civil asset forfeiture related to cryptocurrency.
